The Department of Labor and Employment (DOLE) has recently issued Labor Advisory No. 28 regarding payment of 13th month pay of rank and file employees. Guidelines are as follows:
13th month pay shall not be less than one-twelfth (1/12) of the total basic salary earned by an employee within a calendar year
Entitled employees are those who worked for at least one (1) month during the calendar year regardless of their position, designation, or employment status
Payment should be on or before December 24, 2020
Exemption or deferment of the 13th month pay is not allowed
A report of the employer’s compliance with the law must be submitted to the nearest Regional Office not later than January 15 of the following year.
